1. Acceptance of Terms
Welcome to Moment. These Terms of Service ("Terms") govern your access to and use of the Moment iOS application ("App," "Service," or "Moment"), developed and operated by Moment ("we," "us," or "our"). By downloading, installing, or using Moment, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
We may update these Terms from time to time. Your continued use of Moment after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
2. Description of the Service
Moment is an iOS audio journaling application designed to help you build a reflective journaling habit through the simplicity of your voice. The Service includes:
- Daily prompts — Thoughtful questions delivered each day to inspire your journal entries
- Audio recording — Record your thoughts and reflections with your voice
- Playback — Listen back to your previous journal entries at any time
- Streaks — Track your consistency and build a daily journaling habit
- Prompts library — Browse and choose from a curated collection of journaling prompts
Moment is available on iOS devices and requires a compatible iPhone running a supported version of iOS.
3. User Content and Data Ownership
Your journal entries are deeply personal, and we built Moment with that in mind.
- You own your content. All audio recordings, transcriptions, and journal data you create within Moment belong entirely to you. We claim no ownership or rights over your content.
- Your data stays on your device. Moment stores your recordings and journal data locally on your device. We do not upload, transmit, or store your audio recordings or personal journal content on any external servers.
- No data selling. We will never sell, license, or share your personal data or journal content with third parties for advertising or marketing purposes.
You are solely responsible for maintaining backups of your data. If you delete the App or lose access to your device, your locally stored journal entries may be permanently lost.
4. Account and Eligibility
Moment does not require you to create an account. No email address, username, or personal information is needed to use the App. You must be at least 13 years of age to use Moment. By using the App, you represent that you meet this age requirement.
5. Subscriptions and Billing
Moment offers both free and premium tiers. Certain features require a Moment Premium subscription.
- Pricing: Moment Premium is available at $3.99 per month or $29.99 per year. Prices are in US dollars and may vary by region based on Apple's pricing matrix.
- Billing: All subscriptions are managed through Apple In-App Purchase (StoreKit 2). Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Cancellation: You can manage or cancel your subscription at any time through your Apple ID settings on your device (Settings > [Your Name] > Subscriptions). Cancellation takes effect at the end of the current billing period; you will retain access to premium features until then.
- Free trial: If a free trial is offered, any unused portion of the trial period will be forfeited once you purchase a subscription.
- Refunds: Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.
6. Premium Features
A Moment Premium subscription unlocks additional capabilities, including:
- Transcription — Automatic speech-to-text transcription of your audio journal entries
- Custom prompts — Create your own personalized journaling prompts
- Flexible timing — Customize when you receive your daily prompt notifications
- Edit while recording — Pause, rewind, and edit your recordings before saving
We may add, modify, or remove premium features at our discretion. We will endeavor to communicate significant changes to subscribers in advance.
7. Third-Party Services
Moment integrates with the following third-party services. By using these features, you acknowledge and agree to the respective third-party terms:
- TelemetryDeck — We use TelemetryDeck for privacy-friendly, anonymous usage analytics to help us understand how Moment is used and improve the App. TelemetryDeck does not collect personally identifiable information. For more details, see TelemetryDeck's Privacy Policy.
- Firebase Crashlytics — We use Firebase Crashlytics by Google for crash reporting and stability monitoring. Crash reports help us identify and fix bugs. These reports may include device information and crash logs but do not include your journal content. See Firebase's Terms of Service for more information.
8. Intellectual Property
The Moment brand, name, logo, visual design, user interface, prompts library content, and all associated intellectual property are owned by Moment and protected by applicable intellectual property laws.
You may not:
- Copy, modify, distribute, or create derivative works based on the App or its design
- Reverse-engineer, decompile, or disassemble any part of the App
- Use the Moment brand, name, or logo without prior written permission
- Reproduce or redistribute the curated prompts library content outside of the App
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
9. Acceptable Use
You agree not to use Moment to:
- Violate any applicable laws or regulations
- Record conversations without the consent of all parties where required by law
- Attempt to interfere with, compromise, or disrupt the App's functionality or security
- Use automated systems or bots to interact with the App
- Circumvent or disable any security or access controls within the App
10. Disclaimers
Moment is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- Any defects will be corrected in a timely manner
- The App will be compatible with all devices or operating system versions
Transcription accuracy: The speech-to-text transcription feature is provided as a convenience and relies on on-device speech recognition technology. We make no guarantees regarding the accuracy, completeness, or reliability of transcriptions. Transcriptions may contain errors, particularly with accents, background noise, specialized terminology, or unclear speech. You should not rely solely on transcriptions for critical or legal purposes.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Moment and its developers, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, recordings, or journal entries
- Loss of profits or revenue
- Damages arising from your use of or inability to use the App
- Damages arising from any third-party services integrated with the App
- Damages arising from unauthorized access to your device or data
In no event shall our total liability to you for all claims arising from or related to these Terms or the App exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Moment and its developers, officers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
We reserve the right to suspend or terminate your access to Moment at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms.
You may stop using Moment at any time by deleting the App from your device. If you have an active subscription, remember to cancel it through your Apple ID settings to avoid further charges.
Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitation of liability) will continue to apply.
14. Changes to Terms
We may revise these Terms at any time by posting the updated version on this page with a new "Last updated" date. Material changes will be communicated through the App or via other reasonable means.
Your continued use of Moment after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree with the updated Terms, you should discontinue your use of the App.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of Moment shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the courts of competent jurisdiction.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moment regarding your use of the App, and supersede any prior agreements or understandings.
